GDPR, which refers to the General Data Protection Regulation, applies to all businesses who work with personal data, regardless of the size of the business. This new law came into effect in May 2018 and will still apply even after Brexit.
What is GDPR?
GDPR is a new law that replaced the DPA (Data Protection Directive). This allows clients to have more control over the data that you hold, and they can request access to their own data at any time. They can also request to have their information removed or altered.
There must also be more initiative to ensure that clients understand how and why you are collecting their data, and how you plan to use their data in the future.

What happens if I do not comply?
There are two tiers of administrative fines that can be levied as penalties for non-compliance:
- Up to €10 million, or 2% annual global turnover — whichever is higher.
- Up to €20 million, or 4% annual global turnover — whichever is higher.
The fines are based on the specific articles of the Regulation that the organisation has breached. Infringements of the organisation’s obligations, including data security breaches, will be subject to the lower level, whereas infringements of an individual’s privacy rights will be subject to the higher level.
